How Cohen Legal Can Help
Residential Property Conveyancing
The experienced team at Cohen Legal will ensure that the conveyancing process for you is straightforward, from signing the contract to final settlement, including:
- Contract preparation & compliance with all terms
- Undertaking thorough property searches to identify encumbrances or issues
- Completing the settlement
- Registering documents to transfer the legal title
Title Disputes
Disagreements over land ownership, whether between co-owners, family members, or creditors, can quickly become complex and emotional. It’s best to get advice as early as possible. The property lawyers from Cohen Legal can provide advice to help resolve disputes around title, caveats, easements, and co-ownership arrangements.
Residential Property Disputes
Disputes with landlords, tenants, neighbours, or co-owners can quickly escalate. We offer clear advice and strong representation with lease breaches, eviction matters, body corporate disputes, and joint tenancy severance to protect your interests. Cohen Legal lawyers represent both landlords and tenants in negotiating resolutions or pursuing remedies such as relief against forfeiture orders
Body Corporate & Community Titles
Buying or owning in a community titles scheme means being part of a body corporate, which comes with shared responsibilities, rights, and obligations. From by-laws and levies to maintenance of common property and dispute resolution, these rules can directly affect your day-to-day living and long-term investment.
At Cohen Legal, we help homeowners and buyers understand exactly what body corporate membership means, provide advice on community management statements, and resolve issues when they arise. We have extensive experience in representing clients in proceedings before QCAT, adjudications by the Body Corporate and Community Management Commissioner, and appeals.
Our goal is to make strata living straightforward and ensure your rights are protected within the community.
Easement & Boundary Issues
Easements create ongoing rights and obligations that affect both current and future property owners. They generally provide a right of way over the subject land or access, but do not create rights of possession. No two easements are the same, therefore disputes often arise over their scope or use.
Poorly drafted terms can reduce the value of your property or limit its use.
Our Property Lawyers negotiate easement acquisitions to ensure your interests are protected and the terms are clear, practical, and commercially sound. The team at Cohen Legal has extensive experience in this area of law and possesses an ability to quickly deliver reliable outcomes for our clients.
Loans and Securities
Mortgages, loans, guarantees, charges, and other securities require strict documentation which should be carefully drafted to protect lenders and borrowers alike. Cohen Legal property lawyers can prepare and review all security documentation to ensure it is legally enforceable and aligned with your commercial objectives.
Co-ownership & Title Protection
Co-owning property can be practical, but it often becomes complicated when circumstances change or disagreements arise. You may wish to separate your ownership rights, protect your share in the property, or resolve disputes with a co-owner following a family breakdown or investment issue.
At Cohen Legal, our property lawyers provide clear, strategic advice on co-ownership arrangements, severing joint tenancies, and safeguarding your interests. We guide you through the legal process with a focus on protecting your rights and achieving fair, practical outcomes.
Caveats
Lodging a caveat is a serious step and should never be done without legal advice. A caveat places a notice on a property’s title, preventing any sale or dealings until the issue is resolved, and it warns others that you may have a legal interest in the property.
However, you must have a valid reason, known as a “caveatable interest”, to support it. If a caveat is lodged incorrectly, it can be removed by the Supreme Court and may expose you to significant costs.
At Cohen Legal, we help clients determine whether a caveat is appropriate, prepare the necessary documents, and take action to protect your interests if proceedings become necessary.
